Kolegji i Gjykat\u00ebs Supreme e ka refuzuar si t\u00eb pabazuar k\u00ebrkes\u00ebpadin\u00eb e padit\u00ebses nga Rrjeti i Femrave p\u00ebr Zhvillim Profesional \u201cArrita\u201d, e paraqitur kund\u00ebr Ministris\u00eb s\u00eb Arsimit, me t\u00eb cil\u00ebn ka k\u00ebrkuar q\u00eb t\u00eb shpallet i paligjsh\u00ebm dhe t\u00eb shfuqizohet Udh\u00ebzimi Administrativ q\u00eb ndalon shamin\u00eb n\u00eb shkolla (Kodi i Mir\u00ebsjelljes dhe Masat Disiplinore p\u00ebr Nx\u00ebn\u00ebs t\u00eb Shkollave t\u00eb Mesme t\u00eb Larta).<\/strong><\/p>\n

Gjykata tha se e ka shqyrtuar me kujdes baz\u00ebn ligjore t\u00eb aktit n\u00ebnligjor dhe tha se ka vl\u00ebr\u00ebsuar se ka autorizim t\u00eb qart\u00eb ligjor p\u00ebr t\u00eb p\u00ebrcaktuar rregulla p\u00ebr sjelljen e nx\u00ebn\u00ebsve, p\u00ebrfshir\u00eb edhe rregullat p\u00ebr veshjen \u2013 uniform\u00ebn.<\/p>\n

\u201cPadit\u00ebsja pretendon se me Udh\u00ebzimin Administrativ nr.06\/2014, q\u00eb \u00ebsht\u00eb nj\u00eb akt administrativ i p\u00ebrgjithsh\u00ebm, nuk mund t\u00eb ndalohet ushtrimi i t\u00eb drejtave dhe lirive kushtetuese t\u00eb vajzave q\u00eb mbajn\u00eb shamin\u00eb e kok\u00ebs (mbules\u00ebn islame). E nj\u00ebjta ka theksuar se me neni 55.1 t\u00eb Kushtetut\u00ebs, sakt\u00ebsohet qart\u00eb se \u201ct\u00eb drejtat dhe lirit\u00eb themelore t\u00eb garantuara me k\u00ebt\u00eb Kushtetut\u00eb, mund t\u00eb kufizohen vet\u00ebm me ligj\u201d, duke shtuar se n\u00eb kat\u00ebr vitet e fundit kan\u00eb pranuar ankesa t\u00eb shumta nga vajzat q\u00eb jan\u00eb p\u00ebrjashtuar nga shkollat publike ose t\u00eb cilave u \u00ebsht\u00eb pezulluar vijimi i rregullt i procesit m\u00ebsimor p\u00ebr shkak t\u00eb bartjes s\u00eb shamis\u00eb n\u00eb kok\u00eb\u201d.<\/em><\/p>\n

\u201cGjykata Supreme e Kosov\u00ebs ka shqyrtuar me kujdes baz\u00ebn ligjore t\u00eb aktit n\u00ebnligjor normativ t\u00eb kontestuar, p\u00ebrkat\u00ebsisht Udh\u00ebzimit Administrativ Nr.06\/2014, dhe ka vler\u00ebsuar se dispozita nga neni 3 paragraf 1, n\u00ebn paragraf 1.13, gjen mb\u00ebshtetje n\u00eb Ligjin nr. 04\/L-032 p\u00ebr Arsimin Parauniversitar n\u00eb Republik\u00ebn e Kosov\u00ebs dhe n\u00eb Ligjin nr. 04\/L-138 p\u00ebr Arsimin dhe Aft\u00ebsimin Profesional. Nga k\u00ebto dispozita rezulton se Ministria e Arsimit, Shkenc\u00ebs dhe Teknologjis\u00eb, ka autorizim t\u00eb qart\u00eb ligjor p\u00ebr t\u00eb p\u00ebrcaktuar rregulla p\u00ebr sjelljen e nx\u00ebn\u00ebsve, p\u00ebrfshir\u00eb edhe rregullat p\u00ebr veshjen \u2013 uniform\u00ebn. Rrjedhimisht, akti n\u00ebnligjor \u00ebsht\u00eb n\u00eb p\u00ebrputhje me autorizimin e shprehur ligjor t\u00eb dh\u00ebn\u00eb nga ligjv\u00ebn\u00ebsi. P\u00ebrcaktimi sikurse n\u00eb aktin e kontestuar, me t\u00eb cilin ndalohet bartja e uniform\u00ebs fetare n\u00eb shkolla, gjen mb\u00ebshtetje n\u00eb nj\u00eb akt m\u00eb t\u00eb lart\u00eb ligjor p\u00ebr nga fuqia hierarkike, andaj si i till\u00eb nuk mund t\u00eb shfuqizohet\u201d.<\/em><\/p>\n

Gjykata \u00ebsht\u00eb kufizuar n\u00eb arsyetimin e pretendimeve, p\u00ebrkitazi me nenin 55 paragraf 1 t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, p\u00ebrkat\u00ebsisht p\u00ebr kufizimin e liris\u00eb s\u00eb besimit dhe fes\u00eb, si nj\u00eb nd\u00ebr t\u00eb drejtat dhe lirit\u00eb themelore t\u00eb njeriut t\u00eb garantuara me Kushtetut\u00ebn e Republik\u00ebs s\u00eb Kosov\u00ebs.<\/p>\n

\u201cNd\u00ebrlidhur me k\u00ebt\u00eb, Gjykata rikujton se, Gjykata Kushtetuese e Republik\u00ebs s\u00eb Kosov\u00ebs, me aktvendimin nr. KI 36\/11, t\u00eb dat\u00ebs 30 shtator 2011, n\u00eb interpretim t\u00eb drejtave dhe lirive themelore n\u00eb pajtim me vendimet gjyq\u00ebsore t\u00eb Gjykat\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut (GJEDNJ), n\u00eb pik\u00ebn 76 t\u00eb aktvendimit t\u00eb saj ka theksuar se: liria fetare \u00ebsht\u00eb kryesisht nj\u00eb \u00e7\u00ebshtje e nd\u00ebrgjegjes individuale dhe p\u00ebrfshin edhe manifestimin e fes\u00eb n\u00eb m\u00ebnyr\u00eb private dhe publike, por nuk mbulon \u00e7do veprim t\u00eb motivuar nga feja. N\u00eb nj\u00eb shoq\u00ebri demokratike ku bashk\u00ebjetojn\u00eb fe t\u00eb ndryshme, kjo liri mund t\u00eb kufizohet p\u00ebr t\u00eb ruajtur harmonin\u00eb dhe respektin p\u00ebr besimet e t\u00eb gjith\u00eb qytetar\u00ebve, duke theksuar rolin neutral dhe t\u00eb paansh\u00ebm t\u00eb shtetit si garant i toleranc\u00ebs fetare. Gjykata ka v\u00ebn\u00eb n\u00eb dukje se rregullat lidhur me bartjen e simboleve fetare n\u00eb institucionet arsimore ndryshojn\u00eb nga vendi n\u00eb vend, duke u bazuar n\u00eb traditat komb\u00ebtare dhe nevoj\u00ebn p\u00ebr mbrojtjen e t\u00eb drejtave dhe rendit publik\u201d.<\/em><\/p>\n

Gjykata po ashtu ka rikujtuar se Gjykata Evropiane e t\u00eb Drejtave t\u00eb Njeriut n\u00eb shum\u00eb raste \u00ebsht\u00eb p\u00ebrballur me ankesa q\u00eb pretendonin se nj\u00eb individ i \u00ebsht\u00eb n\u00ebnshtruar trajtimit diskriminues n\u00eb baz\u00eb t\u00eb fes\u00eb apo besimit.<\/p>\n

Prandaj, Gjykata Supreme thot\u00eb se vler\u00ebson se ligjdh\u00ebn\u00ebsi, n\u00eb m\u00ebnyr\u00eb t\u00eb t\u00ebrthort\u00eb por t\u00eb qart\u00eb, ka p\u00ebrcaktuar kufizime t\u00eb pranueshme n\u00eb lidhje me veshjen e nx\u00ebn\u00ebsve, duke i l\u00ebn\u00eb n\u00eb kompetenc\u00eb t\u00eb ministris\u00eb p\u00ebrkat\u00ebse caktimin e k\u00ebtyre rregullave n\u00ebp\u00ebrmjet akteve n\u00ebnligjore.<\/p>\n

\u201cGjykata Supreme \u00e7mon se rregullat e miratuara nga Ministria e Arsimit, Shkenc\u00ebs dhe Teknologjis\u00eb, t\u00eb cilat ndalojn\u00eb bartjen e \u00e7do veshjeje tjet\u00ebr p\u00ebrve\u00e7 uniform\u00ebs shkollore, jan\u00eb n\u00eb p\u00ebrputhje me ligjin dhe me kompetenc\u00ebn e deleguar ligjore, dhe si t\u00eb tilla nuk p\u00ebrb\u00ebjn\u00eb tejkalim t\u00eb autorizimeve t\u00eb dh\u00ebna nga ligjdh\u00ebn\u00ebsi\u201d.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"
