N\u00eb fillim t\u00eb intervist\u00ebs, nj\u00ebri prej punonj\u00ebsve, gjat\u00eb leximit t\u00eb nj\u00eb dokumenti, iu referua Republik\u00ebs s\u00eb Kosov\u00ebs me fjal\u00ebt \u2018Kosovo i Metohija\u2019 (\u2018Kosov\u00eb dhe Metohi\u2019. N\u00eb at\u00eb moment, ankuesi nuk ngriti ndonj\u00eb kund\u00ebrshtim dhe shqet\u00ebsim n\u00eb lidhje me p\u00ebrdorimin e shprehjes \u2018Kosov\u00eb dhe Metohi\u2019, pasi u k\u00ebshillua t\u00eb mos e b\u00ebnte k\u00ebt\u00eb nga mbrojt\u00ebsi i tij. Megjithat\u00eb, n\u00eb fund t\u00eb intervist\u00ebs, ai shprehu shqet\u00ebsimin e tij p\u00ebr p\u00ebrdorimin e k\u00ebsaj shprehjeje n\u00eb dokumentacion\u201d, thuhet n\u00eb ankes\u00ebn e t\u00eb intervistuarit drejtuar Avokatit t\u00eb Popullit.<\/p>\n<p>\u201cAi n\u00eb vijim parashtron se p\u00ebrdorimi i nj\u00eb etiketimi t\u00eb till\u00eb p\u00ebr t\u00eb p\u00ebrshkruar Kosov\u00ebn \u00ebsht\u00eb i neveritsh\u00ebm dhe ngre shqet\u00ebsime p\u00ebr konceptin q\u00eb ka ZPS-ja p\u00ebr shtetin dhe njer\u00ebzit q\u00eb p\u00ebrfaq\u00ebson. Ai pretendon se p\u00ebrdorimi i termit \u2018Kosov\u00eb dhe Metohi\u2019 nga ZPS-ja bie ndesh me nenin 1 t\u00eb Kushtetut\u00ebs s\u00eb Kosov\u00ebs\u201d, thuhet nd\u00ebr t\u00eb tjera n\u00eb ankes\u00ebn e t\u00eb intervistuarit drejtuar Avokatit t\u00eb Popullit.<\/p>\n<p>Ankuesi gjithashtu pretendon se p\u00ebrdorimi i termit nuk ishte thjesht rezultat i nj\u00eb gabimi gjuh\u00ebsor nga ana e p\u00ebrfaq\u00ebsuesit t\u00eb ZPS-s\u00eb, dhe v\u00eb n\u00eb dukje faktin se p\u00ebrfaq\u00ebsuesi n\u00eb fjal\u00eb po e lexonte nga nj\u00eb dokument kur p\u00ebrdori k\u00ebt\u00eb term.<\/p>\n<p>Nd\u00ebrsa m\u00eb 9 shkurt 2023, ZPS-ja iu p\u00ebrgjigj Avokatit t\u00eb Popullit. ZPS e pranoi zyrtarisht se termi \u201cKosovo i Metohija\u201d ishte p\u00ebrdorur n\u00eb intervist\u00ebn me ankuesin dhe pranoi se kjo ishte b\u00ebr\u00eb gabimisht.<\/p>\n<p>\u201cZPS-ja deklaroi se ky term nuk \u00ebsht\u00eb pjes\u00eb e praktik\u00ebs standarde t\u00eb ZPS-s\u00eb dhe nuk p\u00ebrdoret as n\u00eb modelet standarde ose pro forma t\u00eb dokumenteve q\u00eb p\u00ebrdor ZPS-ja. ZPS-ja hodhi posht\u00eb pretendimin e ankuesit se punonj\u00ebsit e saj ishin treguar mosp\u00ebrfill\u00ebs ndaj ankes\u00ebs s\u00eb tij, t\u00eb cil\u00ebn ai ua kishte shprehur n\u00eb p\u00ebrfundim t\u00eb intervist\u00ebs. ZPS-ja informoi Avokatin e Popullit se pas intervist\u00ebs, ishin nd\u00ebrmarr\u00eb disa hapa p\u00ebr t\u00eb p\u00ebrcaktuar se si kishte ndodhur ky gabim dhe p\u00ebr t\u00eb parandaluar p\u00ebrs\u00ebritjen e tij. Gjithashtu, punonj\u00ebsve u ishin dh\u00ebn\u00eb udh\u00ebzime t\u00eb m\u00ebtejshme n\u00eb lidhje me kontekstin e k\u00ebtij termi\u201d, thuhet n\u00eb arsyetimin e ZPS-s\u00eb.<\/p>\n<p>Avokati i Popullit pranon se p\u00ebrdorimi i termit \u2018Kosov\u00eb dhe Metohi\u2019 ishte fyes p\u00ebr ankuesin. Pavar\u00ebsisht k\u00ebsaj, sipas Avokatit t\u00eb Popullit, ZPS e kishte p\u00ebrdorur k\u00ebt\u00eb term n\u00eb m\u00ebnyr\u00eb t\u00eb paq\u00ebllimshme dhe gabimisht.<\/p>\n<p>Avokati i Popullit e ka rr\u00ebzuar k\u00ebt\u00eb ankes\u00eb duke u bazuar n\u00eb rregulloren 29(3)(b) t\u00eb Rregullores s\u00eb Procedur\u00ebs dhe t\u00eb Provave, pasi n\u00eb t\u00eb nuk provohet se ka pasur shkelje t\u00eb t\u00eb drejtave t\u00eb njeriut nga ZPS-ja.<\/p>\n<p>\u201cAvokati i Popullit \u00ebsht\u00eb bindur se ZPS-ja ka marr\u00eb masat e duhura p\u00ebr t\u00eb siguruar q\u00eb gabimi i b\u00ebr\u00eb me p\u00ebrdorimin e shprehjes \u2018Kosov\u00eb dhe Metohi\u2019 t\u00eb<br \/>\nmos p\u00ebrs\u00ebritet.
