RTK obligohet ta kthej\u00eb Berish\u00ebn n\u00eb vendin e pun\u00ebs dhe t\u2019ia paguaj\u00eb mbi 28 mij\u00eb euro p\u00ebr kompensim t\u00eb pagave.<\/strong><\/p>\n<p>Berisha kishte parashtuar padi m\u00eb 7 tetor 2022, p\u00ebrmes t\u00eb cil\u00ebs ka k\u00ebrkuar kthimin n\u00eb vendin e pun\u00ebs n\u00eb Radio Televizionin e Kosov\u00ebs (RTK) dhe kompensimin e pagave p\u00ebr muajt sa ka qen\u00eb i larguar nga puna n\u00eb shum\u00ebn prej 28 mij\u00eb e 492 euro e 97 cent\u00eb, raporton\u00a0<a href=\"https:\/\/betimiperdrejtesi.com\/gjykata-e-kthen-ne-pune-rid-berishen-e-detyron-rtk-ne-tia-paguaje-mbi-28-mije-euro\/?fbclid=IwY2xjawI-rq5leHRuA2FlbQIxMAABHRoCjB9WdJuoPRPXB7vWgPRhLRfebnKPd3d2IxeXpiXPfPKj6EsZJbcxvg_aem_3RAZgSSuMzNAGSb7g9tr6w\">\u201cBetimi p\u00ebr Drejt\u00ebsi\u201d.<\/a><\/p>\n<p>Kurse, e paditura- RTK n\u00eb p\u00ebrgjigjen n\u00eb padi, thuhet se ka kund\u00ebrshtuar n\u00eb t\u00ebr\u00ebsi k\u00ebrkes\u00ebpadin\u00eb e Berish\u00ebs si t\u00eb pabazuar.<\/p>\n<p>Andaj, Gjykata ka gjetur se padia e Berish\u00ebs \u00ebsht\u00eb e bazuar dhe se ka qen\u00eb brenda afatit ligjor, pasi q\u00eb t\u00eb nj\u00ebjtit i \u00ebsht\u00eb dor\u00ebzuar vendimi i RTK-s\u00eb (i dat\u00ebs 23 shtator 2022) p\u00ebrmes e-mailit, pa t\u00eb drejt\u00eb ankese, p\u00ebr \u00e7ka Berisha pastaj ka ushtruar padin\u00eb.<\/p>\n<p>N\u00eb vendim thuhet se p\u00ebr nd\u00ebrpreje t\u00eb mardh\u00ebnies s\u00eb pun\u00ebs, pun\u00ebdh\u00ebn\u00ebsi \u00ebsht\u00eb i detyruar t\u00eb ndjek\u00eb procedurat p\u00ebrkat\u00ebse ligjore, duke u v\u00ebrtetuar n\u00eb t\u00ebr\u00ebsi gjendja faktike dhe duke i garantuar subjektit mbrojtje, t\u00eb cil\u00ebn sipas gjykat\u00ebs, RTK del t\u00eb mos e ket\u00eb b\u00ebr\u00eb.<\/p>\n<p>Po ashtu, n\u00eb vendim thuhet se RTK \u00ebsht\u00eb dashur q\u00eb n\u00eb afatin prej 5 dit\u00ebsh t\u00eb parashtroj\u00eb k\u00ebrkes\u00ebs p\u00ebr inicim t\u00eb procedur\u00ebs disiplinore ndaj Berish\u00ebs. Me rastin e nd\u00ebrprerjes s\u00eb marr\u00ebdh\u00ebnies s\u00eb pun\u00ebs, RTK thuhet se \u00ebsht\u00eb dashur ta th\u00ebrras\u00eb n\u00eb takim padit\u00ebsin p\u00ebr t\u2019ia sqaruar vendimin dhe p\u00ebr t\u2019i dh\u00ebn\u00eb mund\u00ebsin\u00eb e deklarimit.<\/p>\n<p>Dhe se sipas Gjykat\u00ebs, paraprakisht pun\u00ebdh\u00ebn\u00ebsi duhet t\u00eb zhvilloj\u00eb procedur\u00ebn p\u00ebrkat\u00ebse duke verifikuar dhe v\u00ebrtetuar n\u00eb t\u00ebr\u00ebsi gjendjen faktike p\u00ebr shkeljet e pretenduara, t\u00eb jet\u00eb i arsyetuar mir\u00eb, pastaj t\u00eb nd\u00ebrpres marr\u00ebdh\u00ebnien e pun\u00ebs.<\/p>\n<p>\u201c<em>Andaj si p\u00ebrfundim gjykata gjeti se moszbatimi i nj\u00eb procedure t\u00eb drejt\u00eb disiplinore ndaj padit\u00ebsit, ka b\u00ebr\u00eb q\u00eb edhe gjendja faktike t\u00eb mos v\u00ebrtetohet drejt\u00eb kurse kjo ka pasur p\u00ebr pasoj\u00eb mos v\u00ebrtetimin e shkeljeve t\u00eb cilat i jan\u00eb v\u00ebn\u00eb n\u00eb barr\u00eb padit\u00ebsit, qoft\u00eb edhe me nj\u00eb prov\u00eb t\u00eb vetme dhe si rrjedhoj\u00eb ka rezultuar me nxjerrjen e nj\u00eb vendimi t\u00eb drejt\u00eb dhe t\u00eb ligjsh\u00ebm<\/em>\u201c, thuhet n\u00eb vendim.<\/p>\n<p>Sipas vendimit, RTK-ja e ka larguar Berish\u00ebn p\u00ebr shkak t\u00eb paraqitjeve t\u00eb vazhdueshme n\u00ebp\u00ebr media n\u00eb kund\u00ebrshtim me rregulloret e brendshme t\u00eb RTK-s\u00eb dhe instruksionet e menaxhmentit.
