Dy prej ish-udh\u00ebheq\u00ebsve t\u00eb U\u00c7K-s\u00eb q\u00eb po e vazhdojn\u00eb p\u00ebrballjen me drejt\u00ebsin\u00eb e Dhomave t\u00eb Specializuara, Rexhep Selimi e Jakup Krasniqi, e kan\u00eb humbur nj\u00eb betej\u00eb n\u00eb Gjykat\u00ebn e Apelit n\u00eb Hag\u00eb.<\/strong><\/p>\n

Kjo nd\u00ebrlidhur me pranimin si prova t\u00eb disa deklaratave q\u00eb Selimi e Krasniqi kishin dh\u00ebn\u00eb koh\u00eb m\u00eb par\u00eb n\u00eb Tribunalin e Hag\u00ebs dhe Prokurorin\u00eb Speciale t\u00eb Kosov\u00ebs.<\/p>\n

Disa prej k\u00ebtyre provave ishin pranuar n\u00eb muajin n\u00ebntor t\u00eb vitit t\u00eb kaluar. Por, Selimi e Krasniqi vendos\u00ebn t\u00eb ankohen n\u00eb Gjykat\u00ebn e Apelit t\u00eb Speciales, me arsyetimin se jan\u00eb shkelur procedurat.<\/p>\n

Megjithat\u00eb, edhe Gjykata e Apelit ka rr\u00ebzuar ankes\u00ebn e tyre, dhe si rezultat disa prej deklaratave q\u00eb t\u00eb dy kan\u00eb dh\u00ebn\u00eb n\u00eb t\u00eb kaluar\u00ebn, kan\u00eb mbetur si prova n\u00eb procesin gjyq\u00ebsor aktual.<\/p>\n

Fjala \u00ebsht\u00eb p\u00ebr disa deklarata q\u00eb Rexhep Selimi e Jakup Krasniqi kishin dh\u00ebn\u00eb n\u00eb procese t\u00eb ndryshme n\u00eb Tribunalin e Hag\u00ebs si dhe n\u00eb Prokurorin\u00eb Speciale t\u00eb Kosov\u00ebs. Gjykata e Apelit n\u00eb Hag\u00eb ka gjetur se nuk ka pasur ndonj\u00eb shkelje n\u00eb vendimin e shkall\u00ebs s\u00eb par\u00eb.<\/p>\n

\u201cKolegji i Apelit fillimisht do t\u00eb trajtoj\u00eb pretendimin e t\u00eb akuzuarve se d\u00ebshmit\u00eb e Krasniqit dhe Selimit jan\u00eb marr\u00eb n\u00eb m\u00ebnyr\u00eb q\u00eb nuk \u00ebsht\u00eb n\u00eb p\u00ebrputhje me t\u00eb drejtat e t\u00eb dyshuarit. N\u00eb fillim, Kolegji i Apelit thekson se Selimi nuk argumenton se ai kishte t\u00eb drejt\u00eb t\u00eb dyshonte p\u00ebr garanci n\u00eb koh\u00ebn kur ai dha d\u00ebshmit\u00eb e tij n\u00eb TPNJ ose PSRK.1 Sa i p\u00ebrket Krasniqit, Kolegji rikujton konstatimin e tij m\u00eb lart se Trupi Gjykues nuk gaboi duke mos e trajtuar at\u00eb si t\u00eb dyshuar kur ai dha provat e tij nga ICTY. Pavar\u00ebsisht n\u00ebse nj\u00eb pjes\u00eb apo t\u00ebr\u00ebsia e t\u00eb dyshuarit garanton \u2013 si\u00e7 p\u00ebrfshihet nd\u00ebr t\u00eb tjera n\u00eb nenin 38(3) t\u00eb Ligjit dhe rregullat 42 deri n\u00eb 44 t\u00eb Rregullave118 \u200b\u200b\u2013 nuk iu dhan\u00eb Krasniqit dhe Selimit kur ata dhan\u00eb provat, ata nuk kishin t\u00eb drejt\u00eb p\u00ebr garanci t\u00eb tilla n\u00eb koh\u00ebn kur neni 6 i KEDNJ nuk ishte i zbatuesh\u00ebm p\u00ebr ta si d\u00ebshmitar\u00eb\u201d,<\/i>\u00a0thuhet n\u00eb vendimin e Gjykat\u00ebs e Apelit, raporton Nacionale.<\/p>\n

\u201cSi rezultat, fakti q\u00eb k\u00ebto garanci nuk u jan\u00eb dh\u00ebn\u00eb atyre n\u00eb at\u00eb koh\u00eb nuk p\u00ebrb\u00ebn n\u00eb vetvete shkelje t\u00eb standardeve t\u00eb ligjit nd\u00ebrkomb\u00ebtar p\u00ebr t\u00eb drejtat e njeriut n\u00eb p\u00ebrputhje me Rregullin 138(2) t\u00eb Rregullave. N\u00eb k\u00ebt\u00eb kuptim, Kolegji i Apelit nuk sheh asnj\u00eb gabim n\u00eb konstatimin e Trupit Gjykues se TPNJ-ja nuk ishte e obliguar t’i informonte Krasniqin dhe Selimin p\u00ebr privilegjin e tyre kund\u00ebr vet\u00eb-inkriminimit pasi ata konsideroheshin si d\u00ebshmitar\u00eb dhe jo si t\u00eb dyshuar. 119 Rrjedhimisht, nuk \u00ebsht\u00eb e nevojshme q\u00eb Kolegji i Apelit t\u00eb angazhohet n\u00eb vler\u00ebsimin n\u00ebse t\u00eb Akuzuarve iu mor\u00ebn t\u00eb gjitha ose disa nga garancit\u00eb e t\u00eb dyshuarve kur ata dhan\u00eb provat e tyre t\u00eb TPNJ-s\u00eb dhe PSRK-s\u00eb\u201d,<\/i>\u00a0thuhet m\u00eb tutje n\u00eb k\u00ebt\u00eb vendim t\u00eb Apelit t\u00eb Speciales.<\/p>\n

N\u00eb nj\u00eb pjes\u00eb t\u00eb vendimit, APeli dha nj\u00eb arsyetim pse nuk ka shkelje as n\u00eb pranimin e provave e d\u00ebshmive q\u00eb Selimi e Krasniqi kishin dh\u00ebn\u00eb n\u00eb Tribunalin p\u00ebr krime lufte n\u00eb ish-Jugosllavi.<\/p>\n

\u201cTrupi gjykues rikujton se kur vendosi t\u00eb pranoj\u00eb provat e TPNJ-s\u00eb t\u00eb Krasniqit dhe d\u00ebshmit\u00eb e TPNJ-s\u00eb dhe t\u00eb PSRK-s\u00eb t\u00eb Selimit, Trupi Gjykues n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrs\u00ebritur konstatoi se \u201cgrumbullimi i plot\u00eb i paralajm\u00ebrimeve p\u00ebr nj\u00eb t\u00eb dyshuar nuk \u00ebsht\u00eb normalisht i nevojsh\u00ebm p\u00ebr q\u00ebllimin e pranimit n\u00eb procedurat pasuese t\u00eb nj\u00eb deklarate t\u00eb dh\u00ebn\u00eb si d\u00ebshmitar\u201d. Sipas mendimit t\u00eb Panelit, kjo gjetje pasqyron nj\u00eb keqinterpretim t\u00eb standardeve p\u00ebrkat\u00ebse ligjore t\u00eb vendosura nga GJEDNJ. Nd\u00ebrsa, si\u00e7 u konstatua m\u00eb lart, nuk ka asnj\u00eb k\u00ebrkes\u00eb p\u00ebr t’i dh\u00ebn\u00eb paralajm\u00ebrime t\u00eb tilla nj\u00eb d\u00ebshmitari n\u00eb koh\u00ebn kur ai ose ajo jep d\u00ebshmi, pranimi i k\u00ebsaj prove n\u00eb procedurat e m\u00ebvonshme ende mund t\u00eb cenoj\u00eb t\u00eb drejtat e t\u00eb akuzuarit kund\u00ebr vet\u00eb-inkriminimit pik\u00ebrisht p\u00ebr shkak t\u00eb rrethanat n\u00eb t\u00eb cilat \u00ebsht\u00eb marr\u00eb n\u00eb koh\u00ebn kur k\u00ebto paralajm\u00ebrime nuk ishin t\u00eb zbatueshme\u201d,<\/i>\u00a0thuhet n\u00eb vendimin e shkall\u00ebs s\u00eb dyt\u00eb.<\/p>\n

Sipas vendimit, k\u00ebto deklarata jan\u00eb t\u00eb r\u00ebnd\u00ebsishme p\u00ebr procesin, dhe ato jan\u00eb marr\u00eb pa asnj\u00eb shkelje.<\/p>\n
